About the new RDA
PROV has released a new Retention and Disposal Authority (RDA) to authorise the disposal of records under the Historical Homosexual Conviction Expungement Scheme (the Scheme) which are subject to the Public Records Act 1973.
The new RDA, PROS 18/02 Retention and Disposal Authority for Records of the Historical Homosexual Conviction Expungement Scheme, covers functions unique to the assessment of applications for the expungement of convictions or findings of guilt relating to "historical homosexual offences" as defined in the Historical Homosexual Conviction Expungement Scheme, created under Part 8 of the Sentencing Act 1991. It has a single function:

Development of the RDA
This RDA was drafted by PROV in collaboration with staff from the Department of Justice and Regulation. Multiple stakeholders were consulted during the RDA’s development.
Scope of the RDA
This RDA will apply to records documenting the assessment of applications for expungement. Agencies within the Scheme are covered under the scope of this RDA. These are:
- The Department of Justice and Regulation
- The Victorian Civil and Administrative Tribunal
- The Office of Public Prosecutions
- The Supreme Court
- The County Court
- The Magistrates' Court
- The Children's Court
- Victoria Police
Secondary electronic records of expunged convictions will continue to be covered by PROS 16/04 Retention and Disposal Authority for Secondary Electronic Records of Expunged Convictions.
NB: this RDA is not concerned with the original records of convictions, refer to the retention and disposal authorities for the Office of Public Prosecutions and Victoria Police. Nor does the RDA apply to records documenting legislative or policy development, refer to PROS 07/01 General Retention and Disposal Authority for Records of Common Administrative Functions.
